Website Terms and Conditions 


For the simple fact of using our ("Website"), You agree that you have read, understood and accepted these Terms and Conditions.


The term(s) "You", "User", "Buyer" shall mean the person who uses the Website and/or purchases goods through the Online Store (term defined below), regardless of whether uses uppercase, lowercase, mixed; singular or plural.


FIRST. Responsible for the Website.

SECOND. Object.


These Terms and Conditions govern the operations and commercial relationship carried out between the User (“Buyer”) of the online store hosted on the Website (“Online Store”), and Hemera.


THIRD. Purchasing process.


To make purchases in the Online Store, the Buyer must select the goods or goods to be purchased and add them to the shopping cart.


The shopping cart will contain the following information regarding the selected goods:


  1. SKU

  2. Name

  3. Size

  4. Color

  5. Price


To make the purchase of the goods selected in the shopping cart, the Buyer can register in advance in the Online Store or carry out the operation as a "guest", in both cases they must provide the following information:


  1. Full name, as it appears on your official identification.

  2. Email.

  3. Delivery address.

  4. Data for billing (if the Buyer requires an invoice for the purchase) including full tax address, name or full name of the person to whom the invoice will be issued and registration code in the Federal Taxpayer Registry.

  5. Phone number.


Additionally, the Buyer must select the form of payment, under any of the modalities established in the FIFTH section of these Terms and Conditions and provide, where appropriate, the data required to make the payment.


Once the information is provided and the payment is made, HEMERA will send an email to the Buyer, confirming that their order has been received and providing them with an order number to track their delivery or any information related to it. However, order confirmation does not mean acceptance of the order. The order constitutes an offer for HEMERA to purchase the goods that are the subject of the corresponding order. All orders are subject to their acceptance by HEMERA, as well as their availability. HEMERA is not obliged to accept the order and may, at its discretion, refuse to accept it. The Buyer, however, acknowledges and accepts that by confirming the payment at the end of the entire purchase process, he acquires the obligation to pay the prices of the goods when HEMERA accepts the order. In this sense, when HEMERA accepts the order, it will notify the Buyer through a new email confirming that the order has been sent or, where appropriate, that it is available for collection (the "Order Acceptance"). HEMERA is not obliged to deliver any goods or orders that have not been confirmed.


QUARTER. Delivery and shipping.


The shipment of the purchased goods will be made by HEMERA at the time HEMERA notifies the Acceptance of the Order. HEMERA will send an email to the Buyer to inform him that his order has been shipped, as long as he has also received the payment of the price. For no reason HEMERA will send the goods if there is no indubitable proof of receipt of payment.


In order to deliver the goods, the Buyer must specify, at the time of carrying out the purchase process, a real, valid and complete delivery address (with Street, Exterior and Interior Number, if applicable, Colonia, Delegation or Municipality, State and Postal Code) located in the United Mexican States or actual, valid and complete delivery address abroad. Once the purchase has been processed and the order confirmed, the Buyer will not be able to modify the data (including the delivery address and the specifications of the purchased good) for which, HEMERA does not assume any responsibility in the event of an erroneous or inaccurate capture of data from the Buyer.


The delivery time may vary depending on the distance to which the purchased goods must be sent and may range from 2 to 5 business days for national shipments and from 15 to 30 calendar days for international shipments. At the time of carrying out the purchase process, HEMERA will inform the Buyer of the rate for the shipment of the good, so that the Buyer can previously approve it before making any payment. 


The shipment of merchandise purchased through the Online Store will be carried out by external parcel service to HEMERA. In the order confirmation email sent by HEMERA to the address provided by the Buyer, the guide number and the name of the parcel company in charge of making the delivery will be informed, so that the Buyer can track the shipment.


In the event that the Buyer or any person authorized to receive the merchandise is not at the indicated address at the time of delivery, the parcel company will make two more attempts at said address to make the delivery. If after these two attempts the delivery cannot be made at the indicated address, the merchandise will be returned to HEMERA's facilities and, in the event that the Buyer wishes a new shipment of said merchandise, he must cover the corresponding expenses.  


In case of theft or loss of the package by the parcel company during the transit of the order, the Buyer will be notified of said theft or loss by email in which case, HEMERA will provide the Buyer with the option to replace the good at no cost. , the acquisition of a new product or the return of the amount paid.


FIFTH. Payment Methods.


During the purchase process, the Buyer must choose a form of payment, among the following:


  1. Full online payment using a credit card (Visa, Mastercard or American Express) or debit card (Visa or Mastercard), in which case, the Buyer must provide the card number, holder, expiration date and security code .


  1. Total payment online through the PayPal platform.


  1. Interbank transfer, in which case, in the order confirmation email sent by HEMERA, the necessary information to make said transfer will be sent, as well as the corresponding instructions to send the proof of payment.


In the event that HEMERA considers that there is any risk of fraud or any conduct that could constitute a crime on the part of the Buyer at the time of making the payment, for security reasons, HEMERA may request the necessary documentation to verify the ownership of the account through from which the payment is made and/or eliminate any reasonable doubt about the legitimacy of the payment or the origin of the funds, in which case, the Buyer will have a maximum period of seven (7) calendar days to send the requested documentation . If the information is not received and/or any inconsistency is found in the documents, the order will be canceled and HEMERA will make a full refund of the amount paid to the original account. In this case, HEMERA will not process the shipment of the merchandise until all the documentation is received to the satisfaction of HEMERA that proves the legitimacy of the payment, the legal origin of the funds or the ownership of the account through which it is made. said payment.


SIXTH. Availability of goods.


The Buyer accepts and acknowledges that the delivery of goods purchased in HEMERA's Online Store is subject to the condition that said goods are available in HEMERA's inventory at the time of crediting the corresponding payment.


In the event that any purchased item is not available in inventory, HEMERA will notify the Buyer by email, in which case, the Buyer may choose to receive a similar product at no additional cost or a refund of the amount paid.


SEVENTH. Use of the Website.


HEMERA informs that the acquisition of goods through the Online Store of the Website is reserved for persons of legal age according to the jurisdiction of their residence in full exercise of their legal capacity. It will be the sole responsibility of the parents or legally designated guardians, the use of the Website by minors or persons declared in a state of interdiction.


HEMERA reserves the right to cancel any order or purchase made and, where appropriate, to return the amount paid, if it considers that said order or purchase was made by a minor or person declared in a state of interdiction without the proper authorization of their parents or legally appointed guardians.  


EIGHTH. Billing.


In case of requiring an invoice, this must be requested by the Buyer at the time of carrying out the purchase process, selecting the option to require an invoice and informing the true and valid fiscal data, or else, sending an email within the same month in which it is received. have made the purchase through email For no reason will extemporaneous invoices be issued.


The corresponding electronic invoice (in PDF and XML files) will be sent to the email provided by the Buyer no later than five (5) business days after the date of payment or the Buyer's request.


NINTH. Warranty.


HEMERA offers the Buyer a guarantee on the goods purchased in its Online Store only for manufacturing defects or in the event that the size sent does not correspond to the one indicated by the Buyer at the time of purchase. In the event that the Buyer wishes to validate said guarantee, he must enforce it within 30 (thirty) calendar days following the date of delivery of the purchased good by sending an email with the order number and the reason for the return to


The Buyer must send clear photographs of all angles of the product by email of the defective merchandise or in the wrong size in order to validate the guarantee.


HEMERA will inspect the photographs or the good and will determine, based on the verification of the state of the product and purchase conditions, within a period of no more than five business days, if the guarantee is appropriate. If appropriate, the Buyer may opt for the replacement of the merchandise (if available in inventory) or the refund of the amount paid. If the validity of the guarantee is approved, the product must arrive at HEMERA in the same conditions shown in the photographs sent.


In the event that the purchased product is not to the Buyer's liking, the Customer may contact HEMERA within thirty (30) calendar days following the delivery date, to the email indicated in this section, explaining the reasons why. which said well was not to his liking. HEMERA will analyze the Buyer's request and it will be up to the Buyer's decision to exchange or return the merchandise, in which case, it will inform the Buyer of its decision within a period of no more than five business days.


The guarantee will not be valid if the product shows signs of use, without labels, damaged or if it is dirty or mistreated.


To make any change of merchandise, the product must be returned by the Buyer in the same conditions in which it was sent, that is, including the original box and packaging. The package must be labeled with the order number. The cost of the return freight will be, if applicable, covered by the Buyer or by HEMERA, at the discretion of HEMERA.


Merchandise exchanges are subject to inventory availability, therefore, if the item to be exchanged does not exist in inventory, the Buyer may choose to exchange it for a similar product, or refund the amount paid.


In the case of changes, if the model that the Buyer wishes to acquire when the guarantee is valid is more expensive than the one previously purchased, then he may pay the difference through a bank deposit to HEMERA's account.


If the model that the Buyer wishes to acquire when the guarantee is valid is cheaper than the one purchased previously, the difference will not be returned; you will be given a coupon for the difference, which you can use on your next purchase in the Online Store.


TENTH. Returns.


The Buyer accepts and acknowledges that the amount paid for the goods purchased may only be returned for the following reasons:


  1. Due to manufacturing defects, in the event that the guarantee is valid in accordance with these Terms and Conditions.

  2. Due to lack of availability of goods in HEMERA's inventory.

  3. Due to theft or loss of the property in the transit of delivery of the order.

  4. Because the purchased item is not to the Buyer's liking, only if HEMERA determines it appropriate.

  5. Because there is reasonable doubt about the Legitimacy of the Payment or the origin of the funds or the account through which said payment is made to HEMERA.

  6. In the case of purchases made by minors or persons in a state of interdiction, at the sole decision of HEMERA.


If appropriate, the return will be made in a single exhibition and will be through the means with which the Buyer paid for the merchandise or bank transfer to the account indicated by the Buyer within a period of no more than 20 business days. In no case will cash returns be made.


As soon as HEMERA makes the return, it will send the proof of movement by email to the Buyer.


No exchange or refund will be made for items returned after 30 days of purchase, items without tags, damaged, or if they are dirty or mistreated. IN PROMOTIONAL PRODUCTS, WITH A DISCOUNT, PRICE DISCOUNT OR IN PURCHASES FOR MONTHS WITHOUT INTEREST, THE BUYER MAY NOT REQUEST THE REFUND OF THE PRICE, BUT ONLY THE EXCHANGE OF THE MERCHANDISE.


HEMERA does not carry out online exchanges. If Buyer wishes to exchange an item, a return must be completed and a new order placed. HEMERA does not cover return shipping costs.


Once your returned items are received and inspected, HEMERA will send Buyer an email to notify Buyer that it has been received. You will also be notified of the approval or rejection of your refund. If the refund is approved, it will be processed, and the credit will automatically be applied to your credit card or original method of payment, within 30 business days.


The Buyer acknowledges and accepts that he is responsible for the product until HEMERA notifies him that it has been received.


If you haven't received a refund yet, first check your bank account. Then contact your credit card company, it may take some time before your credit card company processes your refund. ELEVENTH. Claims and Complaints.

HEMERA notifies the Buyer that the prices displayed in the Online Store include Value Added Tax, as well as that any additional cost incurred by them to make the purchase will be informed prior to processing the order, in order to obtain their acceptance. .


Discounted products will display their original price and the price after the discount in their description. Any promotion displayed on the Website may be subject to restrictions and validity, which will be indicated on the Website for the Buyer's knowledge.


The Buyer is informed that the images and colors of products shown on the Website may not appear completely accurate to the eyes of the consumer, since this depends on the image quality, memory of the equipment and the resolution of the monitor used to make use of the Website, which is why HEMERA does not assume any responsibility in this regard.


THIRTEENTH. Security measures.


HEMERA informs the Buyer that it will take all appropriate measures to preserve the confidentiality of the information provided by the Buyer on the Website, including technological protection measures (firewalls), as well as not to share said information with third parties.  




FOURTEENTH. Intellectual property.


HEMERA informs the Buyer that all brands, content, industrial designs, images and texts published on the Website are protected by Industrial and Intellectual Property rights owned by HEMERA.


The use of the Website by the Buyer or User does not authorize them in any way to reproduce or make use by any means or form of said brands, contents, industrial designs, images or texts.


FIFTEENTH. Management of Personal Data.


HEMERA informs the Buyer that all personal data provided will be treated as established in our privacy notice, which can be consulted in the "Privacy Policy" section found on the Website.  


SIXTEENTH. Applicable Law and Jurisdiction.


HEMERA and the Buyer accept and acknowledge that the Federal Consumer Attorney's Office is the authority empowered in administrative proceedings to resolve any controversy between them derived from the commercial operations of the Website. Likewise, HEMERA and the Buyer agree to submit to the applicable laws in force in the United Mexican States and to the competent Courts of Mexico City, for any matter related to the interpretation and compliance with these Terms and Conditions.
